Workplace Harassment and Discrimination
California is an at-will employment state, meaning that in almost all cases an employer can fire you for any or no reason at all. However, an employer cannot fire an employee for discriminatory reasons.
Several protections guaranteed by California law and federal law govern when an employer can be held responsible for harassment, discrimination, retaliation or wrongful termination.
You may have a claim against your employer if you have experienced discrimination based on:
- Gender, including how you express your gender and your gender identity
- Sexual orientation
- Race
- Disability, whether an actual disability, an impairment that you have experienced in the past or a perceived disability by your employer
- Medical condition
- Pregnancy, including requesting time off under the Family and Medical Leave Act (FMLA)
- Age
- National origin
- Religion, including requiring uniforms that don’t allow for religious dress requirements or allow you to practice your religion on required days or times
- Medical condition
- Military service, such as violations of the protections guaranteed by the Uniformed Services Employment and Reemployment Rights Act (USERRA)
- Caste
- Association with a disabled co-worker or disabled family member
Regardless of the industry you work in, remember that you have the same right as anyone else to be free from discrimination or harassment based on your gender, race, sexual orientation, age, religion or any other factor listed above. If you have experienced harassment or discrimination at work, you have the right to seek a legal remedy, and the experienced litigators at Haderlein and Kouyoumdjian LLP can help you defend your rights.
Sexual Harassment In The Workplace
Sexual harassment in California workplaces is strictly prohibited by both state and federal law. However, workers continue to be illegally harassed and made to feel uncomfortable or are forced to quit because of sexual comments, inappropriate touching and requests for sexual contact that have no place in the work environment. If you have experienced sexual harassment at work, contact our firm to discuss your legal options and enforce your rights.
